MyZoho Abuse Reporting Procedure

1. Purpose of this Procedure

This Procedure explains how to report abuse of MyZoho, infringement of intellectual-property rights, and certain illegal or harmful content. It also explains how a MyZoho user may object to specified content restrictions or Account actions. The MyZoho Terms of Service govern your use of the Services and our authority to act on a report.

Use the channel that best fits the issue. A technical support request, an Account-recovery request or a privacy request concerning Zoho's own handling of personal information should be submitted through the channel identified for that purpose rather than as an abuse report.

2. Types of Abuse

  1. Spam, phishing, malware and Account compromise

    Report unsolicited bulk messages, phishing, malicious attachments or links, sender impersonation, suspected malware, or an Account you believe has been compromised by sending an email to abuse@zohocorp.com. If the report concerns an email, include the complete message headers and the relevant message as an attachment , where possible. Do not send passwords, one-time passwords or other Account credentials.

  2. Illegal or harmful content

    Report content or conduct that appears to involve fraud, a credible threat, harassment, sexual exploitation of a child, non-consensual intimate material, unlawful disclosure of private information, impersonation, terrorism, violent extremism or any other serious violation of the MyZoho Terms of Service by sending an email to abuse@zohocorp.com. Identify the precise location of the content, such as the public-link URL, MyZoho email address or other available identifier.

    Do not download, copy or redistribute apparent child sexual abuse material or other illegal material merely to support a report. Send the location information and a short description instead.

3. Information to Include

A report should contain the information reasonably necessary for us to identify and assess the issue, including, as applicable:

  • your name and reliable contact information;

  • the MyZoho email address, public-link URL, message identifier or other precise location of the material or activity;

  • a concise description of the issue and why you believe it violates the MyZoho Terms of Service or applicable law;

  • the date and time of the relevant activity, including the time zone, where this would help us locate it;

  • supporting information sufficient to assess the report;

  • your relationship to an affected person if you submit the report on that person's behalf;

  • the action you request; and

  • a statement that the report is accurate and submitted in good faith.

Do not include passwords, one-time passwords, private keys, unnecessary identity documents or personal information unrelated to the report. A report that does not identify the relevant Account, content or activity may not give us enough information to act.

4. Complaints About a MyZoho User

Except where the grievance redressal mechanism as required by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 applies, we will forward a complaint concerning a user's activities through the Services to the user.

The response period and consequences of not responding to a forwarded complaint are set out in the MyZoho Terms of Service.

Forwarding a complaint, receiving a response or disclosing contact information does not make Zoho a party to the dispute or amount to a determination that either party's position is correct. The complainant and the user remain responsible for addressing the dispute and pursuing any available legal remedy.

5. Intellectual Property Complaints

A copyright owner, trademark owner, owner of another intellectual-property right, or a person authorized to act on the owner's behalf may submit an infringement complaint. The complaint must contain enough information for us to understand the right asserted and locate the material complained of.

  1. Information required for an infringement complaint : Your complaint should include:

    • Your physical or electronic signature;

    • A description of the copyrighted work or other intellectual property that you claim to have been infringed;

    • Details establishing that you are the owner or exclusive licensee of the copyright in the material. If you are reporting as an authorized representative of the rights owner or exclusive licensee, you must provide your details along with the proof of your authority to act on behalf of such rights owner or exclusive licensee.

    • Identification of the material that you claim to be infringing including information regarding its location that would enable it to be located and if possible the URL of such infringing material;

    • Details establishing that the material is infringing your copyright or other intellectual property right and that it is not considered non-infringing under applicable laws.

    • information that would enable us to contact you, such as your address, telephone number, and email address (if available);

    • Details of the person, if known, who is responsible for uploading the material infringing your copyright or any other intellectual property right;

    • Information that would enable us to contact you, such as your address, telephone number, and email address (if available);

    • A statement by you, under penatly of perjury, to the effect that you believe in good faith that the use of the infringing material in the manner complained of is not authorized by the copyright or intellectual property owner, its agent, or the law; and

    • Undertaking that you will file an infringement suit in the competent court against the person responsible for uploading the infringing material and produce the orders of the competent court having jurisdiction, within a period of twenty-one (21) days from the date of receipt of the notice.

  3. If you're from U.S., the following sections apply to you in addition to Section 5(a) of the Abuse Procedure :

    1. Counter Notice Procedure: If material posted by you was removed or disabled following an infringement complaint and you believe the action resulted from mistake or misidentification, you may send a counter notice containing:

      • your physical or electronic signature;

      • identification of the material removed or disabled and the location where it appeared before removal or disabling;

      • a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification; and

      • your name, address and telephone number, together with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located or, if your address is outside the United States, a judicial district in which Zoho Corporation may be found, and that you will accept service of process from the person who submitted the infringement notice or that person's agent.

6. How We Handle Reports

We may review the information supplied, ask for missing information, examine relevant technical records or content, and take any action permitted under the MyZoho Terms of Service or required by law. Depending on the circumstances, we may take no action, issue a warning, restrict a message or public link, remove or disable access to content, preserve information, restrict a feature, suspend or close an Account, or refer apparent illegal activity to a competent authority.

We assess reports in context. Submission of a report does not guarantee that content will be removed or that an Account will be restricted. We may be unable to provide detailed information about our assessment or action where doing so would disclose another person's information, undermine security, facilitate evasion or prejudice an investigation or legal process.

Where appropriate, we may notify the affected user of an action and the general reason for it. We may limit or delay notice where law prohibits notice or where notice could create a safety or security risk, expose a reporter to harm, facilitate evasion or compromise an investigation.

7. Objecting to a MyZoho Action

A MyZoho user may object to a content restriction, suspension or disabling of an Account by writing to legal@zohocorp.com within thirty days after being notified of the action. The objection should identify the Account and the action, explain why the action should be changed, and include relevant supporting information.

We may uphold, modify or reverse the action after reviewing the objection. If content was removed through a statutory copyright process, use the counter-notice or other remedy specified for that process. An objection does not require us to restore content or an Account while the review is pending.

8. False or Abusive Reports

Submit reports honestly. Do not impersonate a rights owner, knowingly misstate facts, alter evidence, submit information you know to be false, or use this Procedure to harass another person or suppress lawful activity. We may reject incomplete, fraudulent, repetitive or abusive reports and may restrict further submissions or take action under the MyZoho Terms of Service. A false infringement notice or counter notice may also expose the sender to legal liability.

9. Changes to this Procedure

We may modify this Procedure to reflect changes to the Services, our reporting channels or applicable law. The dates at the beginning of this Procedure identify the current version and when it takes effect.
